OAKLAND (CBS 5 / KCBS) ― The city of Oakland has been hit with a claim of more than $10,000 by the sister of a man who killed four police officers. The claim alleges the now-17 year old sister of Lovelle Mixon was burned by a stun grenade thrown by SWAT officers.

Two of the cops were killed by an AK-47 wielding Mixon on March 21, who was being sought for shooting two motorcycle officers earlier in the day.

The attorney who filed the claim on behalf of the teenager told the Oakland Tribune that there was no justification for the way she was endangered and treated.

But Oakland attorney John Burris doesn’t see it that way.

"Certainly, I don’t think a jury would be particularly favorable toward it," Burris said. "At some point, in analyzing the case, you have to determine whether the conduct of the officers was unreasonable under the circumstances. And that’s going to be a difficult call, the fact that other people may have been injured as a process, and she may have been one of those, you have to look at it from the perspective of the police officers and what they were confronted with."

The claim is the first step toward recovering damages from the city. If the city council turns it down, a lawsuit can be filed.
